2.9 Safety, Health and Welfare
The employer shall comply with legal requirements regarding safety, health and welfare facilities.
Employers have a duty to ascertain and comply with their responsibilities under the relevant Statute(s) and Regulation(s) and conditions of their contract. Employees have a duty to ascertain and comply with their responsibilities under the relevant Statute(s) and Regulation(s) and conditions of employment before commencing work on a site.
Employees must observe their safety instructions to ensure the safety of themselves and their fellow employees.
Employees must use and not misuse facilities provided for their individual safety, health and welfare.
Protective Equipment and Clothing
The wearing of safety helmets shall extend to all work places where a risk of head injury is present.
Consequently, except where the company or site rules or notices make exception or where the foreseeable risk of head injury is negligible, all employees, adult trainees and apprentices shall wear a safety helmet at all times when in the vicinity of construction operations.
Subject to the use of the appropriate disciplinary procedures under these Rules, action taken by an employer to enforce the wearing and use of Personal Protective Equipment and Clothing shall be supported by the Scottish Joint Industry Board.
Employees will comply with the Employer arrangements relative to the provision and maintenance of Personal Protective Equipment and Clothing.
